Appeal Against the ČSSZ Decision: Step-by-Step Guide + Template

Print

“They ruled against me. Even though I submitted everything!”

Iva is 55 years old. She suffers from chronic back pain, limited mobility, and psychological issues. She applied for a disability pension—carefully, with medical reports and a psychological evaluation. The decision? Denied. The justification simply stated she was “fit for work.” After the initial shock came anger. And doubt. Is it even worth fighting? Will an appeal help? Should she just let it go?

No, she shouldn’t. An appeal against the ČSSZ decision is not a waste of time—it’s often the last real chance to correct a mistake before the courts get involved. And if you do it right, you actually have a good chance.

How do you file an appeal against a disability pension denial by ČSSZ? What should you include? How does the process work? And when is it worth hiring a lawyer? This article gives you a complete step-by-step guide and practical advice.

📘 What this article covers:

  • How and when to file an appeal (objection)

  • What to write in the objection – what to include and attach

  • When to seek legal help

  • How ČSSZ handles objections

  • When and why to take it to court

🕐 Time limit and format: where and how to submit the appeal

In disability cases, the official term for appeal is “námitka” (objection). It must be submitted in writing within 30 days of receiving the decision. The key date is when you received it, not the date on the envelope.

Where to send it?

  • Submit to your local district social security office (OSSZ) – the one that issued the decision

  • They will forward it to ČSSZ headquarters in Prague for review

Accepted submission formats:

  • Paper – by post or in person

  • Electronically – via data mailbox (ČSSZ ID: 49kaiqk)

  • Email with recognized electronic signature (regular email is not enough)

📝 What your objection should include – explained

Start with identifying the decision you are challenging. Then include:

  1. Your personal details – name, birth number, address

  2. Decision details – file number, date issued

  3. Reasons for your disagreement – what was assessed incorrectly

  4. Supporting evidence – new medical reports, psychological evaluations, witness statements

  5. Request for reassessment – e.g. “Please reassess and grant disability of level II”

Don’t underestimate your personal description of your daily limitations. Explain what you can’t do, what a typical day looks like, and how your condition affects your life.

📂 How to improve your chances

  • Submit all current medical reports, ideally no older than 6 months

  • If your condition worsened, document that change

  • Include neurological or psychological assessments, if available

  • Strongly consider having a lawyer or legal expert help draft your objection

📌 ČSSZ often stands by their original ruling unless your appeal is specific and well-argued.

⚖️ What if the appeal is denied?

If ČSSZ rejects your objection, you still have one more option: filing an administrative lawsuit in court.

  • Submit to the regional administrative court

  • Again, the deadline is 30 days from receipt of the objection rejection

  • Legal representation is strongly advised at this stage

Courts can overturn the decision and order ČSSZ to reassess your case.

Objection to Decision Denying Disability Pension

On [date you received the decision], I received the decision of the OSSZ dated [date of the decision], file no. [file number], which denied my application for a disability pension, or recognized only level I disability.

I hereby submit an objection pursuant to § 88 of Act No. 582/1991 Coll.

Reasoning:

I believe that the evaluation of my health condition was incomplete and does not reflect my real work capacity.

The decision fails to consider:

  • [e.g.] Long-term psychological difficulties, confirmed by [doctor/clinic] on [date]

  • Multiple hospitalizations due to [e.g. back pain], proven by discharge summaries

  • My inability to carry out even basic daily tasks – e.g. I can’t walk more than 50 meters without pain and needing support

I am attaching additional medical records that were not available at the time of the original decision, as well as a personal description of my symptoms and how the illness impacts my daily life.

I request:

  • A reassessment of my condition based on the new documentation

  • That a disability pension of [e.g. level II] be granted from the date of application

Sincerely,

[signature]
