📘 How Appeals to the Czech Tax Authority Work

1. When and Why to Appeal
You can appeal any decision that concludes a tax proceeding – typically additional tax assessments, rejected applications, or penalty decisions. You’re not appealing “the tax” itself, but the legal decision. And you need a valid legal reason.

2. Appeal Deadline
The standard deadline is 30 days from the delivery of the decision. If the decision was received via data box, the date of delivery counts. For paper delivery, issues may arise with actual receipt – and missing the deadline is one of the most common (and fatal) errors.

3. What an Appeal Must Include
Simply writing “I appeal” is not enough. Your appeal must contain:

  • Reference to the decision (file number),

  • Reasons for your disagreement,

  • What you are asking for (e.g. cancellation, amendment),

  • Signature and date.

Without these, your appeal can be dismissed as incomplete.

4. Where to File the Appeal
This might surprise you: You file your appeal with the same office that issued the decision – not with the higher authority. That office then either changes the decision on its own (called “self-remedy”), or passes it on to the appellate body (e.g. the Tax Appeals Directorate).
