When Can a Bailiff Enter Your Home and What Can Be Seized
A knock at the door. A stranger in a uniform, badge in hand, a firm look in his eyes. “I’m a court bailiff, here to enforce a debt.” You think it’s a mistake. But it’s not. Can he take your TV? Your child’s laptop?
This is how many people experience their first contact with enforcement proceedings – often completely unprepared.
📌 This article is part of the complete legal guide for debtors: Debt Enforcement in the Czech Republic – Complete Guide for Debtors (Velký rozcestník)
People often search for “when does a bailiff come”, “what can be seized in enforcement”, “what can bailiffs take from your home” or “how to stop a bailiff”. This article answers exactly that – what powers the bailiff has, what can and cannot be seized, and how you can act before it’s too late.
What you’ll learn in this article:
When a bailiff may enter your home
The difference between voluntary and forced entry
What can be seized – and what is protected
How property is listed and how to challenge it
Key steps to take the moment the bailiff shows up
🚪 When can a bailiff come to your home?
A bailiff may come once a final enforceable decision (court ruling or payment order) exists. He is not required to inform you in advance.
Bailiffs can come any day of the week, usually between 6 a.m. and 10 p.m. Even if the debtor isn’t present, they may enter – with a locksmith and police assistance if needed.
🔒 What bailiffs can and cannot seize
They can seize:
– Electronics, furniture, jewellery, artworks
– Cash found on site
– Any valuable movable items
They cannot seize:
– Basic personal items of little value
– Medical or disability aids
– Children’s school supplies
– Items that belong to someone else (but you must prove it!)
‼️ Important: Anything inside the debtor’s residence is presumed to be theirs unless otherwise proven.
⚠️ Real case example
Jana lived with her partner, who had debts. One day, a bailiff came and listed her washing machine and TV for seizure. She had to file a motion to exclude the items from seizure and provide original receipts. A costly lesson.
🛡️ What to do when the bailiff shows up
Stay calm – but don’t sign anything without thinking.
Ask for ID and proof of authority.
Ask what judgment or enforcement order they are acting on.
If items don’t belong to the debtor – prepare evidence.
If in doubt, call a lawyer immediately.
