1. When Is a Car Truly at Risk?
A vehicle is a movable asset and can be subject to seizure. A bailiff will typically assess:
Who is registered as the owner in the vehicle registry
Who uses the car in reality
Where the vehicle was found during the asset inventory
If you’re a debtor and registered as the owner – or even just a user – the car can be listed, secured, and sold. However, many cases are disputable, especially if the car isn’t legally yours.
2. Car Registered to Someone Else?
This is common. A car may be under your partner’s or parent’s name – but you use it regularly. In such cases, the vehicle might be wrongfully seized.
📌 Note: The vehicle registry is not the sole proof of ownership. If you’re the primary user, the bailiff may include the car in the enforcement even if you’re not the legal owner.
⚠️ If the car doesn’t belong to the debtor, the rightful owner can file an exclusion lawsuit (§ 267 Czech Code of Civil Procedure).
3. What If the Car Is Part of Marital Property?
If the vehicle was purchased during a marriage, it is usually part of joint marital property (SJM) – even if it’s only registered under one spouse.
The bailiff can seize the car if the debt was incurred during the marriage and SJM wasn’t narrowed or dissolved.
4. How Does Vehicle Seizure Work?
The bailiff may list the vehicle on site (at your home, garage, or parking spot).
The car may be towed and placed in secured storage.
Police assistance can be called in if needed.
If no other assets are found, the car may be auctioned.
👉 You may be able to file a motion to exclude the vehicle or an exclusion lawsuit.
5. What If the Car Has Already Been Seized?
Verify ownership. If the car doesn’t belong to you, the owner should file an exclusion lawsuit.
If it’s your car but should be protected (e.g. used for work), consider a postponement request or partial halt of enforcement.
Contact a lawyer immediately – timing is critical. You may still recover the car, but fast legal action is essential.
