People often fear that collecting a debt through court means years of fruitless effort and high expenses. But it doesn’t always have to be that way.

🧭 Phases of Court Debt Collection and Their Duration

1) Pre-litigation phase
Before going to court, it’s advised to send a formal pre-suit demand. This can take a few days or weeks, depending on the debtor’s response.

2) Filing a lawsuit or request for payment order
Preparing the lawsuit usually takes a few days if the documents are in order. A payment order is a faster option — a decision may be issued within 1 month.

3) Court proceedings
If a regular trial follows (e.g., the debtor objects to the payment order), expect 3 to 12 months, sometimes even longer.

4) Enforceability of the decision
Once the ruling becomes final, you can request enforcement. This may take several more weeks to initiate.

💰 How Much Does Court Collection Cost?

Court fees:

  • Lawsuit to recover a financial claim – fee is 5% of the claimed amount (minimum CZK 1,000, maximum CZK 2,000,000)

  • Request for a payment order – same fee as for a regular lawsuit

Lawyer’s fees:

Depends on the agreement, usually:

  • Fixed price (e.g., CZK 4,000–8,000 for filing + representation)

  • Hourly rate (typically CZK 2,000–3,000/hour)

  • Percentage of the recovered amount (often 10–20%)

👉 If you win the case, most of the costs are reimbursed by the losing party (the debtor).
