Client Story: Disability Pension Denied, But the Court Said Yes

Print

When the system doesn’t believe you—but truth wins in the end

“They said I was healthy. That I had no serious limitations. But I can’t get out of bed in the morning without help. I live in constant pain. How am I supposed to work when I can’t even stand in line at the store?” – Alena, 52.

I know this story well. Alena was my client. Her disability pension application was rejected twice. First by the local authority (OSSZ), then by ČSSZ after her objection. We filed an administrative complaint – and the court ruled in her favor.

This isn’t rare. Sometimes the system simply doesn’t see what’s obvious. But the court can correct that.

🔍 When and why a court decision can help

Alena has an autoimmune disorder that causes fatigue, joint pain, and memory issues. Her doctor’s reports clearly confirmed this. But the social security doctor claimed she could still do light office work.

Despite not working for five years and despite multiple medical opinions, ČSSZ upheld the rejection. So we went to court.

We submitted:

  • updated medical records,

  • a specialist’s letter,

  • Alena’s personal description of her daily struggles,

  • evidence of failed job attempts.

The court requested a new assessment—this time by the Ministry’s independent medical board. They confirmed Alena qualified for disability level II.

The court overturned the ČSSZ decision. The pension was approved retroactively.

⚠️ Why do these errors happen?

  • Medical evaluations from OSSZ are often vague.

  • Mental and neurological issues are commonly underestimated.

  • Chronic illness is not always properly assessed.

The state isn’t trying to harm you—but the system does fail sometimes. That’s when court intervention matters most.

✅ Lawyer’s insight

“In my experience, administrative complaints are worth it. They’re not just red tape—they give you a real chance to be heard. If you know you’re ill and have been unfairly denied, don’t give up. I help clients like this regularly—and when we act in time, they win.”

Don’t wait and hope the system fixes itself.
