Additional Work in Contracts for Work – How to Protect Yourself

Few things create tension in a work contract like additional work.
Everything was agreed – price, scope, timeline. Suddenly, the contractor claims something wasn’t included and demands more money.
The client disagrees: “Why should I pay more when I didn’t ask for anything extra?”
This is one of the most common legal disputes in construction and service agreements.

Under Czech law, additional work (so-called “vícepráce”) isn’t clearly defined in legislation but is widely understood in practice. These are tasks not originally included in the agreed scope. They can result from unforeseen circumstances or from extra requirements made by the client later.

The critical question is: Were these works actually ordered?
If not, the contractor may not be entitled to payment. Czech courts require that consent be clear and provable – not necessarily in writing, but based on evidence like emails, messages, or testimony.

If the cost of these works substantially increases the total price, the contractor must warn the client in advance under Section 2593 of the Civil Code. Failing to do so could mean they lose their right to payment.

Furthermore, if the contract price is fixed, the room for extra work is minimal. The phrase “final and binding price” drastically limits any price increases.
If the price is only an estimate, the situation is more flexible – but misjudging the boundaries can still lead to serious legal and financial risks.

To avoid disputes, the contract should always define:

  • what qualifies as additional work,

  • how it must be approved,

  • whether written consent is required,

  • and who bears the cost risks.
