The work is finished. Ready to be used. But the client suddenly doesn’t have time to sign the protocol. Or worse – they refuse to sign, even though they’re already using the result.

You start asking: Was the work ever officially handed over? Is my invoice even due yet?

A handover protocol is not a bureaucratic detail. It’s a legal milestone.
It can mean the difference between a paid job and a legal dispute.

What is a handover protocol?

A handover protocol is a written document confirming that the work has been completed and handed over to the client.
It usually includes:

  • the handover date,

  • description of the work,

  • any defects or reservations,

  • confirmation of acceptance.

In legal terms, it determines:

  • when the contractor’s obligation was fulfilled,

  • when warranty starts,

  • when the payment obligation is triggered.

Is it required by Czech law?

Not explicitly.
But if included in the contract, the absence of a signed protocol may mean no formal handover occurred – and that can have serious consequences.

What if the client refuses to sign?

A common tactic. Clients sometimes delay the signature to avoid payment.

What to do:

  1. Prepare a unilateral protocol – describe the work, note that the client refused to sign.

  2. Document your handover attempt – send email invitations, take photos, involve witnesses.

  3. Notify the client – refusal without a valid reason may not delay your right to payment.

Best practices for the protocol:

  • full identification of parties,

  • detailed description of the work,

  • date of handover,

  • list of any defects (or confirmation of none),

  • signatures – or note the refusal to sign.
