🕰️ What determines how long enforcement lasts?

1. Amount of debt and debtor’s financial situation

Small debts may be resolved quickly, especially if the debtor has a steady income or assets. Large debts take longer – especially if no easy recovery path exists.

2. Executor’s activity

Some enforcement officers are proactive, others less so. Some may deliberately wait and see if the debtor “surfaces” voluntarily.

3. Debtor’s cooperation

Those who seek a resolution – e.g. by proposing payments or filing for insolvency – usually reach an end sooner. Ignoring the situation can mean years of passive enforcement and growing costs.

4. Legal defense options

Filing motions to stop enforcement or launching insolvency proceedings may temporarily delay – or complicate – the timeline.

5. Type of enforcement

Bank account seizures are faster. Physical asset seizures (e.g. home visits) take longer. Enforcement on real estate can take years, especially with auctions.


📆 Average enforcement timelines

There is no universal answer, but roughly:

  • 💸 Under 3 months: small debts paid quickly.

  • 📉 1–3 years: standard enforcement with account seizures or wage garnishments.

  • 💤 3–10 years: passive or “dead” enforcement cases with no real progress.

  • ⚰️ Over 10 years: yes, it happens. Some run for 12–15 years or more.


🧯 How does enforcement end?

Enforcement can be terminated through:

  • Full payment of the debt and enforcement fees

  • Court ruling to stop enforcement (e.g. due to objections or inefficiency)

  • Debt discharge in insolvency

  • Executor’s declaration of uncollectibility

Czech law does not set a maximum duration – but there are ways to request termination for lack of purpose or if all reasonable efforts failed.

Martin had a debt of CZK 18,000. After three years of wage garnishment, he had repaid more than double. Yet enforcement continued.
