Does the Medical Assessor Have to See the Applicant in Person?

„No one even saw me. They just read the papers and decided I was healthy.“
That’s what a recent client told me. He applied for a disability pension, submitted all his medical reports, but was never invited to any assessment. Then came the rejection. No face-to-face exam. Is this normal? Can a doctor really decide based solely on paperwork?

Many people search for answers to questions like: “Does the assessor have to see me in person?”, “What happens during the disability pension exam?”, “Can they decide without a medical exam?” This article clarifies when a face-to-face evaluation is required – and what to do if it didn’t happen.

⚖️ Is a face-to-face medical assessment mandatory?

Not always. The assessor from the Czech Social Security Administration (ČSSZ) may decide without personal examination if:

  • all relevant and credible medical records are available,

  • the health condition is clear and well documented,

  • the case is neither complex nor disputed.

But be careful:
➡️ If medical opinions are conflicting, the condition is worsening, or an in-person evaluation is needed to properly assess the severity, a personal exam should take place.


👁️ What if I wasn’t invited to the assessment?

The law doesn’t require a face-to-face exam in every case. However, skipping it may be an error if:

  • your condition is complex,

  • some medical reports were missing,

  • the decision was based on outdated information.

You can challenge the decision. In an appeal or court action, you can argue that your condition wasn’t assessed objectively.


🧾 Real Case Example

Mr. Tomáš suffered from a degenerative spine disease. He had an MRI report and specialist treatment. Yet, his disability claim was denied – without ever being seen by the ČSSZ doctor. He filed an objection, stressing the need for an in-person exam. Eventually, he was granted a level 2 disability pension.
