Short-Term Rental – Airbnb, Guest Accommodation and What the Contract Must Include
Are you planning to rent out your apartment through Airbnb? Or are you offering short-term accommodation to students, tourists, or seasonal workers? Then you’re probably wondering: what kind of contract do you need, and what should it contain?

I’m getting more and more questions about short-term rentals—whether through Airbnb, Booking, or temporary sublets. Many people don’t realize that this isn’t considered a typical apartment lease under Czech law. And that can lead to serious legal problems.
What You’ll Learn in This Article
the difference between lease, sublease, and accommodation contracts
when it counts as a business and what that means for you
what a short-term rental contract must include
what risks you face during inspections or neighbor disputes
why written conditions and rules are essential
Lease × Sublease × Accommodation – What’s the Difference?
Apartment lease is a long-term legal relationship protected by law and meant for housing
Sublease means a tenant gives part or all of the flat to another person (without the landlord’s involvement)
Accommodation is short-term, usually commercial, lodging and follows different rules
Short-term rentals (e.g. Airbnb) fall under the regime of accommodation services. Legally, it’s not a lease contract but an accommodation agreement.
What Must a Short-Term Accommodation Contract Include?
identification of the host and guest
clear description of the premises
price and length of stay
cancellation policy and complaints procedure
rules for behavior, cleaning, and key handover
Without a written agreement, you risk disputes over payment, damages, or length of stay.
Be Careful: Business Rules and Inspections
If you provide accommodation regularly and for profit, it may be considered business activity, which comes with obligations like:
having a trade license
paying taxes (VAT, income tax)
keeping a guest register
reporting to the local municipality (e.g., spa/resort fees)
Many people are unaware of these rules—and that’s why disputes with neighbors or problems with authorities often arise.
Lawyer’s Recommendation
If you’re offering short-term rentals, I recommend:
drafting a simple written accommodation agreement
setting house rules for guests (e.g., quiet hours, cleaning, no parties)
checking whether your activity qualifies as a business
preparing cancellation and damage policies
