When Your Spouse Faces Enforcement – How to Protect Your Property

Print

Imagine finding out your spouse is subject to enforcement proceedings. Your first instinct? Panic. Your mind races: Can they take my bank account? The car? Our flat? And what if everything is in their name—or mine? The truth can be harsh: enforcement doesn’t only concern the debtor but often their closest relatives, especially in marriage. Enforcement on jointly owned property has its own rules—and they might surprise you.

📌 This article is part of the complete legal guide for debtors: Debt Enforcement in the Czech Republic – Complete Guide for Debtors (Velký rozcestník)

People often search for answers to questions like: “If my husband has debts, can they seize my assets?”, “Joint property enforcement in marriage”, or “how to protect my property from my spouse’s debts.” In this article, we look at these issues from a legal perspective and offer advice on what to do if this happens to you.

What You’ll Learn in This Article:

  • What joint marital property (SJM) means in Czech law and how enforcement affects it

  • When enforcement can affect the other spouse’s property

  • How to protect joint property from enforcement

  • Common risks and mistakes

  • When and how a lawyer can help

When Can the Spouse’s Property Be Seized?

If the debt arose during the marriage, it is generally considered part of the joint marital property (SJM). This means enforcement may apply to both spouses’ assets, regardless of who caused the debt.

If, however, one spouse incurred a debt before marriage, or the loan was intended solely for them, it may be considered separate. But beware: you must be able to prove it. Otherwise, the enforcement officer may seize property belonging to both, even if you had nothing to do with the debt.

Real-life Example

One client discovered that her husband had debts from an old business. Although she had no involvement, the enforcement officer blocked half of the funds on their joint account and ordered the seizure of a car she used for work. Why? The car and account were part of the joint marital estate, and the officer acted within the law. Without legal help, she would have lost everything.

How to Protect Your Property

Key options:

  1. Prenuptial or marital agreement to limit joint property – ideal if you foresee problems

  2. Separation of property before a notary or via court – also possible during the marriage

  3. Proof of sole ownership – e.g. gifts, inheritance

  4. Appeals against specific enforcement acts – especially when personal property is wrongly seized

Common Mistakes to Avoid:

❌ Thinking “if it’s in my name, they can’t take it” – this is not enough
❌ Ignoring requests for cooperation – it can make defense harder
❌ Failing to consult a lawyer – may lead to unnecessary loss of property
