How Tax Enforcement Works and How to Defend Yourself

What is tax enforcement?
Tax enforcement in the Czech Republic is the process of collecting a tax debt by the tax authority – not a court or bailiff. The Tax Office, Customs Authority or other body can enforce payment directly, once they have a final and enforceable decision (such as a tax assessment).
This may include:
Freezing a bank account
Garnishing wages
Seizing movable or immovable property
Prohibiting the debtor from disposing of assets
Registering liens or seizures on cars and other property
When does enforcement begin?
Tax enforcement begins when the authority issues an enforcement order (exekuční příkaz). This order does not need to be delivered to the debtor in advance – the effect starts once it’s delivered to a third party (e.g. the bank or employer).
This makes tax enforcement faster and more automatic than regular debt enforcement via court.
Can you defend yourself?
Yes – but timing is crucial. You may:
File an objection against the enforcement order
Ask for suspension or cancellation of enforcement
Apply for a payment deferral
Argue that the enforcement is illegal (e.g. because the debt was already paid or the notice was not delivered)
In all cases, it’s important to act within 8 days of learning about the enforcement – otherwise, your rights may be limited.
Common mistakes
Not knowing about the order. It may be effective without you ever seeing it.
Ignoring tax letters. Delivery by fiction is legally valid in Czechia.
Delaying legal help. Every day can make a difference.
Underestimating the debt. Even small amounts can lead to major consequences.
