Bank Account Frozen by Bailiff – What to Do and How to Get Money Back
You go to a shop and try to pay by card – declined.
You try an ATM. Blocked.
You call your bank and find out a bailiff has frozen your account.
You have no idea what to do, how much they can take, or how to pay rent.
For many people, an account freeze comes as a shock. Often, they don’t even know an enforcement (execution) procedure is underway – let alone that a bailiff can freeze the entire account overnight.

1. Who froze your account – and how to find out
Your bank didn’t freeze your account on its own. Most likely it was a licensed bailiff who:
has a valid enforcement title (e.g. court ruling, payment order),
issued an enforcement order to the bank,
and didn’t need your consent – the order is sufficient.
📌 The bank should notify you within a few days. If not, check the Central Register of Enforcement Actions (CEE).
2. Can the bailiff take all your money?
Unfortunately, yes – at first. If you don’t protect your account, the entire balance can be frozen, unless:
you request the release of the exempt (non-seizable) amount,
or you prove the funds are protected (e.g. social benefits, housing allowance).
👉 Warning: The exempt amount must be actively requested – it’s not automatic.
3. What is the exempt amount and how to get it
Everyone is entitled to keep a minimum amount of money. This includes:
approx. CZK 13,638 per month (as of 2025),
higher amounts if you have children or a spouse,
funds from social benefits, pensions, etc.
📌 Steps to take:
– Ask your bank to release the exempt amount,
– Provide proof of income or benefit type,
– Notify the bailiff as well – they may reduce or cancel the freeze partially.
⚠️ Risks and common mistakes
Not knowing who to contact – expecting the bank to fix it
Failing to provide documents – and getting nothing released
Confusing enforcement with insolvency – different rules apply
A second freeze hits another account – yes, this can happen
🧷 Lawyer’s recommendations
✔ Find out the enforcement file number and bailiff’s name
✔ Immediately request the exempt amount from your bank
✔ Check the origin of the funds – some are fully protected
✔ If the execution is incorrect or already paid – file a motion to stop enforcement
✔ In case of doubt or conflict – consult a lawyer. In many cases, you can get your money back.
⚖️ Real-life example
A man lost his job and had an outstanding debt. Meanwhile, he received a housing allowance.
The full CZK 6,000 was frozen.
After we contacted the bank and bailiff, provided proof, and made a formal request, the amount was fully refunded.
If he hadn’t taken action, the money would have been lost.
