Disability Pension and Change of Diagnosis: What to Do If Your Health Improves or Worsens?

Print

Life changes. So does health. Your condition might have worsened — or perhaps improved. In both cases, a question arises: what should you do if your diagnosis changes while receiving a disability pension?

Do you need to report the change? Can your pension increase or decrease? And what are your options if you disagree with a new medical assessment? Let’s break it down.

👉 Disability Pension – From Entitlement to Appeals (Main Guide)

This article answers frequently searched queries like “disability pension worsening condition”, “change in diagnosis and invalidity”, “increase in disability pension 2025”, or “what to do if health improves with disability”. You’ll find out when to act, when to wait, and what to avoid.

🔄 Your Condition Changed? You Can (and Often Should) Request a Review

If your health has worsened, you may consider:

  • requesting a review of your disability level (e.g., from level II to level III),

  • submitting new medical documentation (outpatient reports, hospitalizations, findings),

  • initiating a new medical assessment.

If your condition has improved, there’s no automatic duty to report this to the Czech Social Security Administration (ČSSZ). However, if you are working intensively, traveling, or visibly engaging in activities inconsistent with your previous assessment, ČSSZ may initiate a review on its own.

⚠️ Risks of Automatic Reassessment

ČSSZ can initiate a review of your health status at any time, typically:

  • during scheduled re-evaluations (usually every 1–3 years),

  • based on information from your health insurance provider, doctor, or employer,

  • based on a third-party report (e.g., neighbor, relative…).

If ČSSZ finds that your condition has significantly improved, your pension may be reduced or revoked.

📘 Real-Life Example

Mrs. Renata had a level II disability due to spinal problems. After an accident, her condition worsened, and she required surgery. The recovery process severely limited her mobility. We submitted a request to increase her disability level, supported with medical records, and within two months, her pension was increased to level III.

✅ Lawyer’s Recommendation

A diagnosis change isn’t automatically a reason to adjust your pension — but it’s a signal. If your condition changes, don’t wait for an official invitation — act:

  • Gather relevant medical documentation.

  • Consider whether the change impacts your ability to work.

  • Consult an expert — sometimes it’s better to file a request, other times to wait.

Don’t rely on the system “not noticing.” The biggest risks usually come from inaction.
