⚖️ Legal Insight
Child support (alimony), whether for a child or a spouse, is considered a priority debt under Czech law. If the other parent (or the government, in case of social assistance) files for enforcement, the claim gets priority in wage garnishments and other collection methods.
Enforcement of alimony often begins with an application for wage deductions, submitted to the enforcement court. Since alimony is prioritized, it can quickly lead to harsh consequences, especially if ignored.
Worse yet, if alimony is unpaid for more than 4 months, the debtor may also face criminal charges for neglecting child support duties (§ 196 of the Criminal Code).
📌 Case from Practice
One client contacted me after receiving a warning that criminal charges would be filed for unpaid alimony. He had suffered a serious injury and was out of work but hadn’t requested a court reduction in the alimony amount. Enforcement had already begun, and he was at risk of losing his driver’s license as a secondary consequence. We resolved the case by filing for a partial cancellation of the enforcement and petitioning the court to retroactively reduce the support amount.
⚠️ Risks and Common Mistakes
❌ Hoping the problem will just go away on its own
❌ Ignoring letters from the bailiff or the court
❌ Failing to file for a reduction of alimony after income loss
❌ Making cash payments with no written record – the other parent denies receiving anything
❌ Missing the opportunity to negotiate a payment plan
✅ Lawyer’s Recommendation
If you’re unable to pay your alimony, don’t wait until it turns into a criminal case or full enforcement. The first step is always to file a petition to modify the alimony in court. The second step – if enforcement is already ongoing – is to work with the bailiff or file a motion to suspend or reduce the enforcement. And if you are the one owed alimony, a lawyer can help you recover it.
