Disability and Debt Enforcement – Can My Disability Pension Be Seized?

Losing your health is hard enough – but what if you start losing your money too? Enforcement can be a devastating experience. But what if you’re receiving a disability pension and suddenly find part of it deducted by the bailiff or seized from your bank account? Clients often ask me whether that’s even legal – and where the protection of your income ends. The answer, unfortunately, is not so simple. In this article, you’ll learn what can and can’t be taken, how much must remain in your hands, and what to do if an error occurs.

📚 Can the bailiff seize my disability pension?

Disability pensions are not automatically protected. On the contrary – if you’re in debt and enforcement is ordered through wage or pension garnishment, the Czech Social Security Administration (ČSSZ) can deduct part of your disability pension.

This depends on:

  • The amount of your pension

  • The number of dependent persons (e.g., spouse, children)

  • Whether the claim is preferential or non-preferential

By law, you are entitled to a non-seizable minimum, which is regularly updated. As of 2025, this is approx. CZK 13,638 + CZK 3,409.50 for each dependent.


💥 Real-life examples

  • Alena, 3rd-degree disability pension, CZK 15,000, no children – the bailiff deducted CZK 1,500 per month due to a preferential debt.

  • Petr, same degree, CZK 11,000 pension and two children – no garnishment applied, as his pension is below the threshold.


⚠️ Risks and common mistakes

  1. Assuming full protection – many people believe pensions can’t be touched. That’s incorrect.

  2. Not reporting dependents – the ČSSZ calculates your non-seizable amount based on registered information. If you don’t report your dependents, you may lose money unnecessarily.

  3. Overlooking unlawful garnishments – both bailiffs and ČSSZ can make mistakes. Act quickly.
