Enforcement Has Ended – What to Do Next and How to Clear Your Record

Print

It’s finally over. The enforcement proceedings are done. But instead of relief, you feel uncertainty. What happens next? What steps should you take to ensure you can really move on – debt-free, record-free, and without legal shadows?

Enforcement (exekuce) is one of the most stressful experiences many people face. But even when it’s over, that doesn’t automatically mean your problems are behind you. Now is the time to make sure no hidden consequences remain – with banks, authorities, or potential employers.

📌 This article is part of the complete legal guide for debtors: Debt Enforcement in the Czech Republic – Complete Guide for Debtors (Velký rozcestník)

What do clients often ask me after enforcement ends?

• Do I still have to pay anything?
• How do I get the enforcement record deleted from registers?
• Can I start a business again or apply for a mortgage?
• Do I need to report this to anyone? To an authority? A former employer?
• What if the enforcement was stopped due to being unenforceable – is my record really clean?

These are the kinds of questions I regularly receive. And it’s a good thing – because the end of enforcement isn’t always the end of the story. Let’s break it down.

What to do after enforcement ends

1. Check your legal status

After enforcement ends, the bailiff (executor) should send you an official decision (usnesení) confirming the termination or cessation. This document is essential. Save it and make copies – you may need it years later.

Caution: Not every “termination” means the debt is paid off. Enforcement may be halted due to uncollectability – in that case, the debt still exists!

2. Clear your name from public and private registers

The enforcement may remain listed in various databases – such as the Central Register of Enforcement Proceedings (CEE) or credit registers. Ask your bailiff for a confirmation of closure and file a request for deletion.

Risk: If you don’t actively request the deletion, the “shadow” of your enforcement may follow you when applying for a bank account, loan, or even a job.

3. Return to normal life with a clean slate

• Resume business activities if they were suspended
• Update your permanent residence if it was changed due to the enforcement
• Reassess your financial situation and start building a safety net

Lawyer’s tip: If you signed any unfair contracts during the enforcement (for example, with debt collectors), consider reviewing or legally challenging them. Enforcement often leads to rash decisions.

You might be thinking…

“If the enforcement is over, then I’m fine, right?”

Not quite. Unless you actively check that everything is really closed and your records are clear, you’re still at risk. The system doesn’t forgive automatically – you have to fight for a clean record yourself.

Real client story

Mr. Tomáš was only removed from the bank register after he sent two copies of the enforcement closure confirmation. Twice they ignored him. He got approved for a mortgage only after he took legal steps to enforce the correction. Being proactive pays off.
