Execution vs. Insolvency: A Legal Fork in the Road

Execution is the process of debt collection once a court decision (or similar document) is final. A court-appointed executor can seize your account, garnish wages, or even sell your property.

Insolvency (personal bankruptcy) is a legal process where you admit you can’t manage your debts and ask the court for debt relief. If the court approves, your debts may be cleared in 3 to 5 years.

So what’s the difference?
Execution means things happen to you. Insolvency means you take control – and all executions are suspended once proceedings begin.


Real-life example

A client of mine was already facing three separate executions – wages and bank account frozen. When a fourth one started, he finally chose bankruptcy. Even with a low income, we managed to file the debt relief petition, and the court approved it. After three years of reasonable monthly payments, the remaining debts were forgiven. Had he stayed in execution, he would’ve lost much more – and for much longer.


Myths and red flags to watch for

  • “Bankruptcy is a scam.” No, it’s not – but shady debt relief agencies are. Never pay large sums upfront to someone who won’t even file your petition.

  • “I’ll lose everything in bankruptcy.” False. You keep your unseizable income – and it’s often higher than in execution.

  • “I can handle the executions.” Maybe. But unpaid interest, new lawsuits, and fines pile up quickly. Many end up worse off.
