Postponement of Enforcement – When Is It Possible and How to Get It
When everything seems hopeless…
Imagine you’re facing eviction, garnished wages, or frozen accounts – while caring for a sick child, recovering from an accident, or waiting for an insolvency decision. The enforcement process continues, and you’re running out of strength. But there is still one option many people miss: a motion to postpone enforcement. It won’t stop it forever, but it can buy you precious time to recover.
📌 This article is part of the complete legal guide for debtors: Debt Enforcement in the Czech Republic – Complete Guide for Debtors (Velký rozcestník)
Search terms like “how to postpone enforcement”, “enforcement and illness”, or “postponement of execution due to children” show that people often struggle to understand when a postponement is legally possible and what needs to be submitted. This article gives you a practical guide on when and how to request it – and when it can really help.
What you’ll learn in this article:
What enforcement postponement is and when it applies under Czech law
Legitimate reasons for postponement (e.g. insolvency, motion to stop enforcement, humanitarian grounds)
Step-by-step: how to file a motion for postponement
Common risks and how to react if the court rejects your request
Real-life examples and a lawyer’s advice
What is enforcement postponement?
Postponement means a temporary suspension of the enforcement process. It doesn’t cancel the enforcement entirely – it remains legally pending but is not carried out for a time.
Debtors can request postponement in the following cases:
if they have filed a motion to stop the enforcement, e.g. claiming the debt has been paid,
if they filed for insolvency and are awaiting court decision,
in exceptionally serious situations – such as illness, caregiving, natural disasters, etc.
How to request postponement
Submit your motion to the enforcement court or the executor (depending on the stage of the process). The motion should include:
the basis for your request (e.g. pending insolvency, motion to stop enforcement),
specific reasons for the postponement,
supporting documents – medical reports, proof of care duties, copy of insolvency filing, etc.
⚠️ Note: Postponement is not automatic. The court considers the circumstances and interests of the creditor.
Risks and common mistakes
Incomplete filings – without supporting documents, the court may reject your motion immediately.
Late submission – if the enforcement has already been completed, postponement is meaningless.
Confusion with a motion to stop enforcement – these are two separate legal tools.
Lawyer’s recommendation
I often see clients filing too late or forgetting to attach proof. A well-prepared motion can prevent unnecessary harm, especially when enforcement would severely affect a vulnerable debtor. If you’re unsure, I strongly recommend getting legal help – at least for a quick review.
