Sound familiar? You’re not alone. A contract for work sounds simple: someone delivers a service or result, and you pay. But what happens when nothing gets delivered? Or what’s delivered is late, poor, or just plain wrong? Most people don’t know if — or how — they can legally get out of the deal. And doing it the wrong way can make things even worse.
How to Terminate a Contract for Work When the Contractor Fails to Deliver
Contracts for work (known in Czech law as smlouva o dílo) are incredibly common — whether it’s building a fence, redesigning a website or renovating an apartment. At first glance, it’s simple: one party creates or repairs something, the other pays.
But when the contractor fails to deliver, delays the job, disappears or delivers poor-quality work, things get complicated fast.
Can you terminate the contract? Yes — but it must be done properly.
There are two main options:
1. Termination (withdrawal)
This cancels the contract retroactively. It’s allowed in case of a serious breach — e.g. major delay, refusal to cooperate, or defects that can’t be fixed.
But the termination must be clear, written, and legally justified. If it’s done wrong, it may not be valid — and you’ll still be bound by the contract.
2. Notice (future termination)
This ends the contract for the future, not retroactively. However, unless this option is explicitly stated in the contract, it’s rarely applicable in practice.
