You’ve received a letter or an email saying you owe money. But you’re not sure – do you really owe this? Could it be a mistake, a scam, or an expired claim?

This is the moment to pause and verify the facts. Many people pay money they never truly owed. Others ignore a valid claim and end up in court. You don’t want to be either.

How can you tell if a debt is legitimate? What should you check before paying? And when is it smart to call a lawyer? This article explains how to recognize a real debt and avoid being tricked.

1. Who is demanding the payment – and why?

Start with the basics:

  • Is it a company you did business with?

  • A collection agency claiming they bought your debt?

  • A lawyer representing someone else?

Always ask: Who? On what grounds? Why now?

2. Check the reason and the amount

Every demand should include:

  • a reference to a contract, invoice, or other legal ground,

  • a clear description of what you supposedly owe and why,

  • total amount, plus any interest or penalties.

If the documents are missing or don’t make sense – beware.

3. Could it be expired or invalid?

Many claims relate to old debts, which may be time-barred (e.g., in the Czech Republic, civil debts expire after 3 years).
Also:

  • There must be clear proof of non-payment.

  • Without a court judgment, no one can force you to pay without evidence.

4. Spotting scams or pressure tactics

Look out for:

  • claims without legal grounds,

  • threats of enforcement without a court decision,

  • urgent language (“Pay now or else…”).

Karel received a payment demand for “unpaid energy bills” from 2018. It came from a collection agency but with no documents attached. After consulting a lawyer, he found the claim was time-barred and wrongly linked to another customer’s account. Without help, he might have paid out of fear.
