How to respond to a pre-litigation notice? What if you ignore it? What does it mean and when should you call a lawyer? This article explains everything you need to know to protect yourself and avoid court.
1. What Is a Pre-Litigation Notice?
It’s an official call to settle a debt or fulfill an obligation before a lawsuit is filed. In many cases – especially between businesses – it’s even a legal requirement before going to court.
2. What It Includes
Usually contains:
names of both parties,
amount and legal basis of the claim (contract, invoice, obligation),
deadline for payment,
warning about possible lawsuit.
3. What Happens If You Ignore It
If you don’t respond, the creditor can sue. And if the debt is legitimate, you may be ordered to pay not only the debt, but also legal fees and court costs.
4. How to Respond
Check the details – is the amount correct and justified?
If you agree: reply and try to settle or negotiate payment.
If you disagree: send a written reply, ideally with legal assistance.
If unsure: get legal advice before responding.
Important: a poorly written or emotional reply may be used against you in court.
