Rights of the Injured Party in Criminal Proceedings
“It was my case – but they spoke as if I wasn’t even there”
“I was defrauded out of hundreds of thousands. Finally, it went to court – but no one told me anything, I wasn’t allowed to view the file, and I didn’t even know when the hearing was. And the defendant’s lawyer spoke as if I were just an obstacle.”
No injured party should feel invisible in a criminal case.
The law grants you many rights – but you need to know them and assert them.

⚖️ What rights does an injured party have?
Under the Criminal Procedure Code, an injured party has the following rights:
Access to the case file
Attend the main trial
Attend the questioning of witnesses
Request explanations and notifications
Claim damages and non-material harm
If the injured party is a minor, a vulnerable victim, or otherwise disadvantaged, they also have special rights (e.g., support from a legal representative, no direct contact with the accused, etc.).
✍️ When to actively assert your rights?
✅ Ideally right after filing the criminal complaint
✅ Don’t wait for the police to contact you
✅ Your rights apply only if you claim them
⚠️ Risks: What happens if you remain silent?
❌ You won’t know about the hearings
❌ You may miss the chance to claim compensation
❌ You lose influence over the course of the case
❌ You may miss out on key evidence or opportunities to comment
🧑⚖️ Lawyer’s advice:
✅ Get legal help from the start
✅ Make full use of your rights
✅ Your voice can change the course of the case
