Imagine sitting at your kitchen table, coffee in hand, staring at a “free lease agreement template” on your screen. Click – download, fill in the names, sign… done, right? But then reality strikes: the tenant stops paying rent, damages appear in the flat, and you search through the contract for legal support – but find nothing. Suddenly, you realise that the “free template” was more like a ticket to legal hell.

“Is a free lease template from the internet enough?” “Can I just modify it myself?” “How do I know if the template is even valid?”
My answer is almost always the same – a template can be a starting point, but it will never replace a tailor-made contract. In my practice, I often see people relying on someone else’s forms and ending up in court. A template only makes sense if you can read it, adapt it, and most importantly – understand what’s missing. Lawyer’s Commentary – Where’s the Problem?

  • Term – no clause about early termination or notice procedure.

  • Rent – no mention of whether it includes utilities, energy, or internet.

  • Security Deposit – no rules on return, deductions for damages, or set-off.

  • Repairs – “The landlord is responsible for all repairs” is dangerous. The law distinguishes between minor and major repairs, and tenants have obligations too.

  • Missing – precise description of the flat, accessories, handover condition, and “read and agreed” confirmation.


Risks of Using a Poor Template

  • Inability to evict a non-paying tenant without lengthy court proceedings.

  • Unenforceable or invalid penalty clauses.

  • Unclear repair responsibilities → endless disputes.

  • Missing clauses → court may interpret the contract against the landlord.
