Free loan-for-use contract template – and why you shouldn’t use it

At first glance, it looks ideal – type “free loan-for-use agreement template” into Google and in seconds you’ve got a contract.
But that “quick fix” can easily become the costliest mistake.
A single wrong phrase, a missing clause, or an unclear description of the borrowed thing can make your contract invalid – or worse, leave you liable for damages you didn’t cause.

Legal explanation

A loan-for-use agreement is gratuitous, but still legally binding.
It’s subject to the same civil law rules as any other contract (§ 2193 et seq. of the Czech Civil Code).
Even a “free” loan can cause serious financial loss if drafted poorly – for example:

  • the object of the loan is not precisely defined,

  • there’s no mention of purpose or duration,

  • no clause on liability for damage or loss,

  • or, for real estate, the written form is missing, making the contract invalid.


The most common mistakes in “free templates”

  1. Confusing a loan for use with a lease
    – Some templates mention “rent”, “payment” or “rent fee”, changing the legal nature of the contract.

  2. Undefined object
    – Typical phrases like “lending garden tools” or “a flat” with no address or inventory.

  3. No clause on maintenance or repairs
    – Especially for machines or real estate, this creates disputes about who pays for upkeep.

  4. Wrong form for real estate
    – A house, flat, or land must have a written contract; an oral one is invalid.

  5. Missing return clause
    – Without clear rules, the borrower may claim they “returned” it even if it’s damaged.

  6. No liability clause
    – Without this, recovering compensation is extremely difficult.


Example from practice

A client lent her cottage to a friend using a “free loan-for-use template” she found online.
She simply filled in names and a date.
When she returned, the property was damaged and the garden destroyed.
The borrower claimed “it was already like that.”
Because the contract had no handover protocol or description of the property’s condition,
the court ruled against her — she couldn’t prove her claim and lost the case.


Why free templates rarely hold up

“Free template” doesn’t mean “safe template.”
These forms don’t know your situation — whether you’re lending a car, apartment, or equipment to a business or individual.
They lack the protective clauses that make the difference between a valid contract and a worthless document.

Use free templates only as inspiration, never as a final contract.
Every loan-for-use agreement should include at least:

  • a precise identification of the thing,

  • purpose and duration of use,

  • a clause on liability for damage,

  • clear return conditions, and

  • for real estate, written form with signatures.

  • Does it specify who pays for maintenance or repairs?

  • Is the condition at handover documented?

  • Does it include a liability clause?

  • Is it in written form (mandatory for real estate)?
